Halstead Glass terms and conditions
ADDITIONAL WORK:
- Any changes/variations required to the order must be agreed between us and the customer and subsequently confirmed in writing to avoid any potential confusion. It is the responsibility of the customer to produce the written confirmation of the required alterations. Verbal discussions between the customer and any representative of Halstead Glass cannot be relied upon by either party. Please note, prices may be affected dependant on the nature of customer request.
- The details of the order have been determined by an initial survey only. Orders are accepted subject to our official surveyor’s approval. If in the opinion of our surveyor/technical member of staff, the work is not recommended to be carried out, due to safety, access, conditions of property, pricing omissions etc., a full explanation will be provided to the customer in writing with a view to achieving a resolution/variation between us and the customer. If a satisfactory agreement cannot be reached between the said parties, either party has the right to cancel the order. We will not be subject to any penalty as a result of this decision.
- We take care to describe goods as accurately as possible. Sample products and any literature can be used to demonstrate typical goods and their composition. Goods referred to on the order will be manufactured in the way considered suitable by our manufacturers in their professional opinion. The right is reserved for modification. Our manufacturers may make minor technical changes to the specification of the goods (which will not detriment their function).
- It is entirely the responsibility of the customer to make their own enquiries with regard to planning permissions and/or restrictive covenants applicable at the installation address. We are not liable for any claim, expense or consequence caused by the failure of the customer to obtain the appropriate permissions or other such approvals/consents, or for a breach of restrictive covenant or lease obligation.
- We will endeavour to install your goods within a reasonable delivery period. Dates given for the commencement and completion of an installation are given in good faith and are based on circumstances at the date of the order. They carry no guarantee and could be subject to delays, some beyond our control (including but not limited to accidents, strikes, government directions, unavailability of materials/parts). We are not liable for any loss incurred by the customer in this respect. If the customer requests a delay to the scheduled installation date, we will allow a reasonable period to make re-arrangements, at the discretion of our management.
- The utmost care will always be taken during an installation, however, we cannot guarantee that tiles, woodwork, plaster, wallpaper etc. will not be damaged upon the removal of existing goods.
We are under no liability for the responsibility of:
- a) Tiles damaged during the course of installation, retiling or any redecoration
- b) Damage or faults arising from the removal and/or refitting of the customer’s own secondary glazing, blinds, curtain tracks, TV aerials, telephone cables, alarm wiring etc.
- c) Redecorating reveals
- d) Repairs to defective plaster beyond the reveals
- e) Removing existing goods intact and without damage
- f) Non-matching due to weathering/aging of existing finishes to brickwork, pebble-dashing, render or any similar material
- g) The remedy of defects that existed prior to the installation of goods, or for any subsequent damage arising from any such defect.
Without prejudice to the limitation of this paragraph, the customer must report any damage to us in writing, to be received within 14 days of the incident in question.
- Materials that are removed during the installation will be cleared from the site and disposed of (recycled where possible) and cannot be retrieved thereafter. Any asbestos based products we find on your property will be left in place, where possible, with any removed products being left on site. Due to council licensing we are unable to transport any asbestos.
- Glass used is of the best quality reasonably obtainable but may have minor imperfections due to the process of manufacture. We shall not be obliged to make good any such as are not covered by the warranty of our glass manufacturers. Toughened safety glass will be used where necessary (as governed by British Building Regulations and FENSA compliance).
- No guarantee is made that our goods will reduce or eliminate condensation. Condensation is a ventilation issue which varies from property to property. Additional literature is available upon request. We would recommend that the customer studies this should they have any concerns.
- We reserve the right to instruct third party companies (at our discretion) with no additional cost to the customer, should we determine this to be necessary for the benefit of the installation
ELECTRIC:
Our fully qualified electricians will always attempt to work with the existing electrical consumer unit. If however this is impractical, the electrician will advise you of costs involved to enable a safe and satisfactory electrical installation (to comply with Part P Building Control).
PLUMBING:
If it is deemed unviable for a radiator to be installed due to the existing boiler capabilities, Halstead Glass will offer an alternative (Electric Heater) but will not be held liable for any costs to upgrade your current boiler.
DECORATING:
Halstead Glass will not be held liable for any required redecorating. Halstead Glass do not offer any form of decorating. Skirting Boards/Floor Coverings are not included with any installation by Halstead Glass.
GUARANTEE:
Applicable guarantee documentation will be issued to you upon full completion of your installation and full settlement of our invoice.
INSURANCE:
Ten Year Insurance Backed Guarantees are included in the above price, where applicable.
APPEARANCE:
Pilkington Soft Coat Glass has high light transmission and appears virtually the same as clear float glass. However, in rare instances of strong oblique lighting, the coating may be seen as a transparent film. This is simply a transient visual effect, which can be considered positive evidence of the coated surface being present. Further evidence of the coatings presence is through the very minor effect it has on white light transmission. This effect is so small as to be generally unnoticeable. However, when a light coloured object or material is in close proximity to the glazing, dependent on local circumstances and conditions, a slight darkening can be noted.
NOTICE OF THE RIGHT TO CANCEL:
A cooling-off period of fourteen calendar days is applicable commencing at the date of this signed agreement. If you wish to cancel the contract you MUST DO SO IN WRITING and deliver notice of your cancellation personally or send it to Halstead Glass by registered mail. The below Cancellation Notice can be used for this purpose, if required:

DEPOSITS & PAYMENTS
Deposits are applicable to all orders and are due at the outset of the transaction. The deposit and a signed copy of this Contract Agreement must be in our possession to enable us to process your order.
Payment terms are as follows:
Self Finance Orders:
Guardian Warm Roof/Glass Roof Only (to existing conservatory without Building Work)

For any incomplete remedial works 10% of the final balance amount may be retained until works are complete. Please note this is 10% of the final balance, not the total contract amount. All goods remain the property of Halstead Glass until paid for in full.
In circumstances where the contract signatory does not reside at the installation address, i.e. tenanted properties, invoice balances are to be settled in advance of the installation, by close of business the working day prior to the scheduled installation date.
Halstead Glass take no responsibility for the existing structure when replacing a conservatory roof onto existing framework/brickwork. Halstead Glass are able to carry out a ‘test dig’ and analise results at a chargeable fee of £200.00 including VAT.
Finance Orders:
Deposits and subsequent payment terms are variable depending on the agreed finance package you choose. These will be detailed and arranged as part of an independent agreement with the credit supplier.
Halstead Glass Personnel/Installers are authorised to accept cash/cheque in favour of Halstead Glass only. Debit/Credit Card payments are accepted in person or by telephone via our office.
Failure to pay in accordance with the above terms will be a breach of this agreement. Goods remain the property of Halstead Glass until full payment has been made. Deposits are non-refundable (unless cancellation takes place in accordance with the terms of cooling off period). We reserve the right, at our discretion, to instruct a third party company to assist in the recovery of funds. In these circumstances, you will be liable to pay all costs, fees, disbursements and charges (including Legal Fees and costs) incurred during this process.
